Now, Florida families have an option to avoid pitfalls of litigation by utilizing the Collaborative Law Process Act. The collaborative process increases the likelihood of reaching an out-of-court settlement. Florida is now among 13 other states and the District of Columbia to pioneer this procedure to help Florida families. Key to the collaborative process is that the attorneys and parties enter into a Collaborative Law Participation Agreement wherein each commits to resolving matters without intervention of the court. Clients will often begin with, "my case is easy and uncontested - we ‘just’ need to agree on . .[fill in the blank]" Sadly, it is this one remaining item that can throw the entire process into protracted, emotionally draining and expensive litigation. Emotionally charged, people too often are quick to say - "I will see you in court!" This attitude is often later regretted by both parties.
